- Return and Refund Conditions

Items may be returned to Kina NZ Design + Artspace if they are faulty.

Web orders once confirmed cannot be cancelled for a refund. You will be issued a store credit to use at a later date.

Kina NZ Design + Artspace reserves the right to repair or replace the item/s in the first instance. If repairing or replacing the item/s is not available then a store credit will be issued or a refund will be transferred to the customer's bank account.

If you simply change your mind or your circumstances have changed, Kina NZ Design + Artspace does not have to provide a refund or exchange.

It is at the discretion of Kina NZ Design + Artspace to exchange or credit an item that is unwanted due to a change of heart. In such an event the item must be returned within 14 days of purchase.

The customer must notify Kina NZ Design + Artspace of the returning of the item and the reasons for doing so within 4 days of receiving the item.

The goods must be in the same condition as they were when the customer received them.

Return shipping must be organised by the customer.

Exchange or credit will not be given if the customer has damaged the goods. This includes damage caused by inadequate packing when returning goods.

Exchanges or credit will not be given on sale or layby items or items commissioned by the customer.

- Layby Terms & Conditions

At Kina NZ Design + Artspace, we are pleased to offer layby on selected artworks and design pieces. As many of our works are unique and cannot be offered for sale while on layby, we ask that customers enter into a layby agreement only when they are committed to completing their purchase.

1. Eligibility

Layby is available on selected items at the discretion of Kina NZ Design + Artspace. Commissioned works, custom orders and special orders may not be eligible for layby.

2. Deposit

A minimum deposit of 20% of the total purchase price (including GST) is required when the layby agreement is entered into.

3. Payment Period

The remaining balance must be paid in full within 8 weeks of the purchase date, unless another payment arrangement has been agreed to in writing by Kina NZ Design + Artspace.

4. Instalment Payments

Regular payments are required throughout the layby period. If you are unable to make a scheduled payment, please contact us as soon as possible so we can discuss your options.

5. No Changes or Exchanges

Once a layby agreement has commenced, the item(s) on layby cannot be changed, exchanged or substituted for other artwork or products. Any request to purchase different item(s) will require cancellation of the existing layby agreement and the commencement of a new layby agreement, subject to availability.

6. Price

The purchase price of the goods is fixed when the layby agreement is entered into. No interest or finance charges apply.

7. Ownership

Ownership and possession of the goods remain with Kina NZ Design + Artspace until the purchase price has been paid in full.

8. Cancellation by the Customer

You may cancel your layby at any time before taking possession of the goods.

If you cancel your layby, you will receive a refund of the amounts you have paid, less any reasonable cancellation fee (10% of the total layby) permitted under New Zealand law. Any cancellation fee will reflect the actual costs reasonably incurred by Kina NZ Design + Artspace in administering, processing and storing your layby, together with any non-recoverable transaction costs.

9. Cancellation by Kina NZ Design + Artspace

If payments are not made as agreed, or you otherwise fail to comply with these terms, Kina NZ Design + Artspace may cancel the layby agreement after making reasonable attempts to contact you.

If the layby is cancelled, the goods may be returned to stock and any amounts paid will be refunded less any reasonable cancellation fee (10% of the total layby) permitted by law.

10. Goods Unavailable

If, for reasons beyond our control, the goods become unavailable before the layby is completed, Kina NZ Design + Artspace may cancel the layby agreement and will refund all monies paid.

11. Layby Statement

You may request an email statement of your layby account at any time. We will provide this within five working days at no charge. The statement will include the purchase price, payments received, the balance owing, and any applicable cancellation fee.

12. Your Consumer Rights

These Layby Terms & Conditions are governed by the Fair Trading Act 1986, the Consumer Guarantees Act 1993 and other applicable New Zealand consumer legislation. Nothing in these terms limits or excludes your rights under New Zealand law.

 

- Artwork Conditions

The items Kina NZ Design + Artspace sells are handmade. Materials can, therefore, vary in colour, shape and size. These inconsistencies are not deemed faults and claims will only be considered if there are defects in workmanship or defective materials. Claims due to damage by negligence, accident or unreasonable use will not be recognised.

Every effort is made to ensure the accuracy of all descriptions, images and other information displayed but the customer must acknowledge there may be variations in product or materials. If there are any major changes to the product the customer has ordered, Kina NZ Design + Artspace will discuss other options with the customer.

These terms and conditions govern your use of the Kina NZ Design + Artspace online store. By placing an order, you agree to and are bound by these terms. If you are unwilling to comply with these terms, then you may not use Kina NZ Design + Artspace online store.
